§1. Allmänt
 
These Terms and Conditions ("Contract" below) are adjusted for sales over the internet. Fair Value Sweden AB (VAT SE556934-541501) is a seller party. You, ("Customer"), are the purchasing party. You must be of age 18 and over to shop at Promenix.nu 
 
You are accepting the following Terms and Conditions by making your purchase. 
  
§2. Orders
 
At Promenix can you shop easy and secure. We offer secure payments and safe deliveries. When Fair Value Sweden AB receives your order, you will get an email notification. If you do not receive it, please take a look in your Spam folder.When you receive that Notification we consider this contract fulfilled by us.
 
If for any reason it wont be possible for Fair Value Sweden to deliver yout order, you will be contacted without further delays.. If this situation occurs we will offer you a solution or an offer to exchange.When you accept this offer this Contract counts as fulfilled by us.
 
Right to cancellation

You have the right to cancel your order before it is packaged and sent. If the package is already sent out from our shop or the label was paid for and the package is packed and waiting for the delivery it is no longer possible to cancel your order.
 

§3. Prices and charges
 
Original prices on the site are shown in Swedish Kronor (SEK) including Sweidh Tax (MOMS). Moms in Sweden is 25%. Charges for shipping will be calculated individually during check out.
 
Charge for the packages you do not pick up from the post office or do not accept during the delivery

Within Sweden: The charge for this is 350 kr which is deducted from your return sum. This is necessary to cover our expenses which come with this situation. 

From outside Sweden: 500 kr
 
§4. Products and selection
 
All the products on Promenix.nu are safe to sell according to Swedish law and regulations.
 
Photos and colors of the products

We try to portray the colors and whole producs as close to reality as possibke. But since the product looks can strongly vary based on factors like your monitor light/color or the light/color of the room/light bulb. We can not guarantee that the products will be exacly the color/shade you see on the screen. 

Leather products might differ in color even within same pair and have little scratches/imperfections. These are normal and come together with natural qualities of leather products.

We do have all the shoes that you buy from us in the store, children try them on while chosing the right size. By making your purchase you accept that shoes are not going to be untouched.
 
 
§5. Payment
 
Your order will be sent as soon as we receive your payment.

PayPal
If you chose this option you will be sent further to Pay Pal´s site. Follow further instructions there to complete your purchase.

Gift Card

Gift cards are valid for 1 year after the issue. The buyer holds the complete responsibility over safety of the gift card. Stolen or lost gift cards can not be issued again or refunded.

If the gift card expires, it loses all of its worth and can not be claimed in any way.

The products which are bought using Gift Card can only be exchanged. The customer is paying for all the additional costs.

 

§6. Fulfillment
 
Fair Value Sweden AB starts to handle your order when we have received it and can see that the payment went through.
Fair Value Sweden AB has fullfilled this contract when the product has been sent out to the customer
 
 
§7. Delivery
 
Products will be sent out from Promenix within 1-4 working days and are handled by our logistics partners, such as PostNord and DHL.
You will be able to track your order, but we can not guarantee the delivery times with packages sent abroad. Usually the products arrive within a week, but it can take up to 2 month with packages sent overseas or if customs of your country stops the package for inspection.

Fair Value Sweden AB.  holds the right to cancel any orders that we can not fulfill in any way or can not offer you options.
 
The costs of delivery are calculated during your check out.
 
§8. Return policy
 
Return policy

Within Sweden: Customers who enter into this agreement as a private person have the right to withdraw (cancel) the agreement in accordance with the Distance and Home Sales Act (2005:59). The right of withdrawal does not apply to customers who have entered into this agreement as a trader. If you don't like your order or have regretted it, you can return it within 14 days of your purchase for a refund (shipping is not refundable). The right of cancellation is valid for 14 days (the cancellation period), the time is counted from the day on which you as a customer have received the shipment. For the right of withdrawal to apply, the products that the order includes must be returned in essentially unchanged condition. You get to unpack, look at and try your item. If the item is returned because you regret your purchase (right of withdrawal), however, it must not have been used more than is necessary for you to be able to determine the product's characteristics and function, so that you can get back what you paid. According to current legislation, as a customer, after you have canceled your purchase, you must return all products that the order includes to Fair Value Sweden AB and pay for the return shipping yourself. However, Fair Value Sweden AB always has the right to offer the customer more generous terms than what the current legislation prescribes.

From outside of Sweden: Customer will receive refund (Except freight costs) if the package arrives to us within 14 days from receipt of the product by the customer. If longer than 14 days but within 30 days - customer will receive store credit. If product arrives after 30 days no return can be accepted. Send the return with tracking number and insurance, since we can only refund the products which we actually receive, The postage receipt will not be accepted in case of loss of the products on the way to us. 


We ask you not to tape or write on the original box - we need an undamaged box to be able to sell the item to another customer. If we get back cartons that are damaged in such ways, a fee of SEK 300 will be added.
 
When returned products are at Fair Value Sweden AB's disposal, Fair Value Sweden AB will refund what you have paid within 30 days. If the order has been placed against an invoice that you have not yet paid, the invoice will be cancelled. Should you as a customer return fewer products than the order includes, only the merchandise value of the products you return will be refunded.

§9. Claims and warranty
 
Each claim case is different, therefore we will decide on each case separaely. Please send us an email with your order number, description of the problem and photos or video to show us the flaw. 

If the claim is accepted and problem can be mended with cobbler we always prioritize that and will pay for the repair costs.

We do not accept claims if the damage is caused by improper use of shoes (crawling, breaking the bike with toes etc, or the normal wear and tear that appears with time). Accepted claims are the flaws that have appeared because of improper manufacturing of products. For the shoes our cobbler is deciding if the claim belongs to manufacturers error, wear and tear or improper use for each claim separately.

When returning products or materials to Fair Value Sweden AB, the products must be packaged in such a way that they are protected during transport. Fair Value Sweden AB therefore recommends that you always pack products in the same way and with the same packaging as when the products were delivered to you. In the event that you packaged or packaged products in a substandard manner and the product is damaged during transport to Fair Value Sweden AB, you as a customer are also responsible for the damage.

When returning products to Fair Value Sweden AB, you are responsible for the products reaching Fair Value Sweden AB in undamaged condition. Fair Value Sweden AB recommends that the customer uses a trackable shipment when returning.

Refunds

We will refund the money within 14 days at the latest if the right of withdrawal is used or if a refund has been decided in a complaint case.
 
 
§11. Reservation
 
Withdrawal clause

Customer can cancel an order until the shipment was handed over to our shipping provider. After that the cancellation is not possible. Since we usually pack the orders right away, please let us know about your will to cancel straight away!

Dropshipping orders can not be cancelled at all because we make an order from manufacturer straight away and pay for the shoes straight after your order. We do not have an option to cancel your Dropshipping order.
 
Subject to change

Fair Value Sweden AB förbehåller sig rätten att utan avisering ändra innehållet på promenix.nu, vilket inkluderar, men inte är begränsat till, utbud, priser och kampanjer. Sådan ändring påverkar dock ej redan ingångna avtal mellan Fair Value Sweden AB och kund.
 
Liability disclaimer

Fair Value Sweden AB shall be deemed released from all obligations under this agreement for liability that would otherwise have arisen due to an event outside of this agreement, Fair Value Sweden AB's operations or what otherwise follows from mandatory law.
 
§12. Disclaimer
 
Force Majeure

In the event of an action or omission by an authority, new legislation, labor law conflict, war or threat of war, major disturbance of public order, sabotage, extreme weather conditions, fire, explosion, natural disaster, accident or other circumstance beyond Fair Value Sweden AB's control and as Fair Value Sweden AB could not reasonably overcome or foresee, Fair Value Sweden AB shall have the right to waive its obligations in this Agreement. In the event of such an event, Fair Value Sweden AB shall not be liable for damages incurred to the customer.
 
External links

Fair Value Sweden AB is not responsible for any damages and problems with the customer's software or hardware that arise due to the customer using external links that are published on promenix.nu
 
Reservation for price fluctuations or other barriers to trade

In the event of price fluctuations or other obstacles to trade, such as a lack of a necessary component, where Fair Value Sweden AB cannot reasonably be held to its obligations under this agreement, Fair Value Sweden AB has the right to cancel the agreement. In such an event, the customer is not entitled to damages or other compensation from Fair Value Sweden AB.
 
Reservation for tax and fee changes

In the event of significant tax or fee changes, which are of great importance for the conditions for this agreement, Fair Value Sweden AB has the right to cancel the agreement. In such an event, the customer is not entitled to damages or other compensation from Fair Value Sweden AB.
 
Reservation for delivery delay beyond Fair Value Sweden AB's control.

If there is a delivery delay due to an event outside Fair Value Sweden AB's control, Fair Value Sweden AB shall not be considered responsible for damage due to such delivery delay. In the event of such an event, the customer is not entitled to damages or other compensation from Fair Value Sweden AB, unless otherwise specifically agreed between Fair Value Sweden AB and the customer or a provision that follows from mandatory law.
 
 
§13. Personal data and confidentiality
 

Information such as personal data or other information or part of a document that the customer submits to Fair Value Sweden AB will be stored and processed in digital format. Fair Value Sweden AB is responsible for the data being stored and processed in accordance with the Personal Data Act. The customer's data will be used by Fair Value Sweden AB to enable and ensure fulfillment of the Agreement as well as for marketing purposes on the company's part.

If you as a customer entered into this agreement as a private person, you have the right to request a register extract once a year free of charge. A register extract indicates what information is saved about you. You request this by sending a signed request to the above postal address. If the information we have about you is incorrect, incomplete or misleading, we will of course correct this.

Deregistration of customer data:
You as a customer can, upon written and signed request, have your customer data at Fair Value Sweden AB deleted, subject to such
